Right of Withdrawal

(1) Consumers have a statutory right of withdrawal when concluding a distance contract; the provider informs them of this below in accordance with the statutory model. A model withdrawal form is provided in Paragraph 2.

(2) Once the consumer has removed the seal after delivery, the right of withdrawal expires prematurely pursuant to Section 312g (2) No. 3 of the German Civil Code (BGB), as the contract concerns the delivery of sealed goods that are not suitable for return for reasons of health protection or hygiene.

 

Right of Withdrawal:

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you, or a third party named by you who is not the carrier, took possession of the goods.

To exercise your right of withdrawal, you must inform us—Awakening GmbH, Fidicinstrasse 44, DE-10965 Berlin, represented by Managing Director Denis Brodack, e-mail: mail@psychedelika.club—of your decision to withdraw from this contract by means of an unequivocal statement (e.g., a letter sent by post or an e-mail). You may use the attached model withdrawal form for this purpose, but it is not mandatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Consequences of withdrawal:

If you withdraw from this contract, we shall reimburse all payments received from you, including delivery costs (with the exception of the additional costs resulting from your choice of a type of delivery other than the standard delivery offered by us), without undue delay and in any event no later than fourteen days from the day on which we are informed of your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

We may withhold reimbursement until we have received the goods back or until you have supplied evidence of having sent back the goods, whichever is the earliest.

You must send back or hand over the goods to us without undue delay and in any event no later than fourteen days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of fourteen days has expired.

You will bear the direct cost of returning the goods.

You are only liable for any diminished value of the goods resulting from the handling of the goods other than what is necessary to establish the nature, characteristics, and functioning of the goods.

(3) In accordance with statutory regulations, the provider informs you about the model withdrawal form as follows (if you wish to withdraw from the contract, please complete this form and send it back):

In accordance with Section 312g (2) of the German Civil Code (BGB), the right of withdrawal does not apply, or expires prematurely, in the case of the following contracts:

a) for contracts for the supply of goods that are liable to deteriorate or expire rapidly (Section 312g (2) No. 2 BGB), there is no right of withdrawal from the outset;

b) for contracts for the supply of sealed goods which are not suitable for return for reasons of health protection or hygiene, the right of withdrawal expires if the seal has been removed after delivery (Section 312g (2) No. 3 BGB).
